Hi, Can anyone tel me about the ESIC Deduction. ESIC is deducted under 21000 gross. But if gross is higher then 21K, but there are deductions and after the deductions its less than 21K. Is ESIC still deducted? If if no, what actions should be taken with the company, if they are deducting the amount.

If the gross salary is not above Rs 21000/pm you have to deduct ESI,.Net salary below Rs 21000 is irrelevant.

If gross salary is increased to above Rs 21k after april then Esic will be deducted till complete contribution period (Apr-Sep) and ESIC deduction will be stopped from october month salary onwords. Similarly salary increased to above Rs 21k after October then deduction will be continued till Mar (Oct-Mar) and discontinued from April month salary onwords.

As per ESI Act, only regular salary and regular allowances under terms and contacts of employment comes under ceiling of Rs. 21000/-. OT or other casual allowances may cross Rs. 21000/- which is accountable for deduction as these are not counted under upper limit ceiling.
If the IP/IW crosses such regular salary and allowances above 21000/- in April or October, then he is exempted from ESI for following wage period , otherwise he has to contribute upto following September/March (during current wage period) even if he crosses the limit of 21000/-.
ESI contribution is calculated on the gross wages not on net wages.

As per ESIC Act the employee having 21,000 is eligible to participate in ESIC contribution but when when gross salary exceeds 21,000 the employee should be surrender his membership from ESIC by online in the wage month OCT or APRIL.
