Hello everyone,
My wife has been working in a pvt ltd company (registered in Mumbai but office in Haryana) which has less than 10 employees. She has been working there for over 5 years. Is she entitled to maternity benefit? She is one month pregnant and has not disclosed this to her employer. The employer has been trying that she resigns from the job and giving her trouble.
The employment contract does not provide the maternity benefit and there is no employment handbook.
If we include directors (not paid remuneration/sitting fees) then there are 10 people in the company.
I would be very thankful for your advise on the entitlement.

If Factory, no such condition. If Shop or establishment, maternity benefit act may not be applicable. MOHAN KUMAR mohan.kumar551@gmail.com

Hi,
"As per the Government of India, the maternity benefit act is applicable to all companies from 1 April, 2017. It is an Act by the law and the companies need to adhere to the rules formed.
The Applicability states - - Applicable to mines, factories, plantations, shops and commercial establishments.
- For a woman employed, whether directly or through any agency, for wages in any establishment.
