Hello everyone.
I am a complainant under this act and now jobless, since I resigned as I was forced over phone for termination for my complains.After my resignation the company formed an ICC at a back date and in their policy they have provided no ICC formation date,though I asked several times over mail for its formation date.The ICC is absolutely biased and working in favour of respondent trying to prove in all ways that its a false complaint.I am trying hard to for redressal.
My queries are:
1.I have no witnesses, though I had, but they would not speak in my favour as they are all working in the same company-Will that work against me?
2.Respondent has brought forth fake witnesses, I can resolve it by cross examining,but how would that be helpful as ICC is already biased?
3.Can I be accompanied by any relative of mine who is aware of the incident during cross examining the witnesses of respondent?
4.The witnesses who defended the complainant gave their witnesses to ICC in absence of Independent member,is that acceptable?
5. I had asked for legal assistance in a prayer to Presiding officer,which I was denied saying they are not authorized to provide it,now after I have already filed a Criminal case the PO is saying that the ICC would have gladly assisted me had I shared with them for the same.
Requesting all of you to guide me and advice me in the same.
