Dear Sir/Ma'am, I have got the letter regarding PF inspection in our school. I have some queries related to this.
1. There are some employees who were working as a part time workers and we do not mention them in our attendance register so please tell me are they eligible for PF deduction.
2. There is 01 employee working on Ad hoc basis which mean she is not regular employee and we do not give salary for the month of june but she is on our regular attendance register is she eligible for PF deduction
3. There was 01 contractor who was providing us 02 Guards for security services (Now removed) but we didnt get any PF challan receipt from him during his service.
His firm name is St. john security & Services so we used to deduct 2% TDS on that. Do we need PF challans copy from him.
And please tell how to tackle the PF inspection that it will goes good.

1. Sir, to make the compliance in respect of contractor employees is the responsibility of the principal employer. You can contact the security contractor and ask him to supply and produce relevant records in original at the time of inspection as fixed by EPFO authorities. In case you will not produce the required records and not show the compliance, the department will be assessing the contribution due on the basis of amounts your unit has paid to the said contractor firm and claim the same from principal employer i.e. your establishment.
2. To add the names of all employees in the Attendance/Muster-roll of the establishment, though is required as per labour laws, but if not maintained, the EPFO authorities will note down the total amounts paid to such persons as wages and claim contributions on such wages. Whether, any of the persons your unit engaged was really part-time or not coverable under the EPF & MPs Act, 1952 is to be decided by the EPFO authorities on the basis of facts and records you will produce before them.

St. john security & Services ಸಂಸ್ಥೆಯೊಂದಿಗಿನ ಒಡಂಡಿಕೆ ಮಾಡಿಕೊಂಡ ಮುಖ್ಯಸ್ಥರನ್ನು principal employer ಎಂದು ಕರೆಯಲ್ಪುಡುತ್ತಾರೆ. ಸಂಸ್ಥೆಗೆ ಕಾರ್ಯಾದೇಶ ನೀಡುವ ಮೊದಲು ಸದರಿ ಸಂಸ್ಥೆ EPF ನೋಂದಣಿ ಮಾಡಿಕೊಂಡಿರುವ ಬಗ್ಗೆ ಪರಿಶೀಲಿಸಿಕೊಳ್ಳಬೇಕಿರುತ್ತದೆ. ನೋಂದಣಿ ಮಾಡಿದ್ದಲ್ಲಿ calculate PF for person with Basic + DA(upto Rs.15000), ಲೆಕ್ಕಹಾಕಬೇಕಿರುತ್ತದೆ. ಸದರ ಸಂಸ್ಥೆ 20 ಸಂಖ್ಯೆಗಿಂತ ಕಡಿಮೆ ಕಾರ್ಮಿಕರನ್ನು ಪೂರೈಸುವ ಸಂಸ್ಥೆಯಾಗಿದ್ದಲ್ಲಿ, ಸದರ ಸಂಸ್ಥೆಗೆ EPF ನೋಂದಣಿಯಿಂದ ವಿನಾಯಿತಿಗೆ ಅವಕಾಶವಿರುತ್ತದೆ. epf ನೋಂದಣಿಯಾಗಿರದಿದ್ದಲ್ಲಿ ಕೂಡಲೇ ಸಂಸ್ಥೆಯೊಂದಿಗಿನ ಕಾರ್ಯಾದೇಶವನ್ನು ರದ್ದುಪಡಿಸಿಕೊಳ್ಳಬಹುದಾಗಿದೆ. padmanabha
