I am working in IT sector from past 2 years. I want to leave organization because of work harassment. Though their was certification and training policy which I was not signed any bond or legal agreements and still I was ready to pay the amount of 1 Lack to get my relieving letter and the policy states that In case the Employee, for any reason, leaves the services of the XXX before the period of eighteen months, then he/she shall forthwith pay a sum of Rs.1,00,000 /- being the indemnification of the cost of training to the Company. The Employee undertakes not to dispute the amount, and shall pay the amount, before requesting for formal relieving order from the XXX & at the same time XXX has full right to initiate appropriate legal proceeding against the Employee.
And this policy was introduced after my completing my 1.5 years journey and they are enforced to sign on this document but I couldn't not signed on this.
However I was ready to pay 1 lack of amount if they ask to pay. When I put my resignation papers in organisation, The manager want to stop me leaving from the company and he states that if you want to leave the company you need to pay sum of 6 lacks amount for the training cost and certification and he states in the email like this " You shall forthwith pay sum of Rs.6 lacks being the indemnification cost of the company. You undertake not to dispute the amount, and shall pay the amount, before requesting for formal relieving and experience letter"
Then later I discussed with my HR about Training and certification policy with respective to bond clearly states that it was clearly written to pay 1 lack of amount and this email took me to surprising 6 lacks of amount but she told to take resignation back and she instated to my resignation back and started harassing me.
I approached a lawyer and with his support sent a legal notice to relieve my experience letter and salary. Since long time they couldn't reply to my notice, the Next company has clearly mentioned without relieving letter we cannot join you. Then later I approached to CEO and made apologized about my notice and he states that 1.Formally withdrawing the legal notice and the claims made therein by way of a letter to be sent by your lawyer on your behalf; 2.The letter specifically acknowledging that the training was indeed imparted to you, that you was aware that the certification training cost USD 4100 for each round of certification and that you were always aware.
I felt this tricky statement and trap. Now I'm under depression and wanted to commit suicide because I feel it, please help me what I can do.What legal actions I can take against my ex- employer since Bonded labor is a crime in India.Please help me.
