I have been working with a UK MNC for last 2 years as Project Manager handling business transformation across UK and South Africa. I returned from Cape Town in May this year with an assurance to relocate back at Cape Town for another 1-2 years. Initial paperwork was progressed with initial agreement that I will be allowed to take my pregnant wife on company expense for the duration of my stay in SA. There has been no progress for the last 8 weeks now, until last week I was asked to leave the company with reason provided for entrenchment as 'Profile required in UK and not India.'
I had signed a 2 months notice period when I joined and the company is now forcing me to resign on a piece of paper effective immediately. They have provided me a letter stating my performance was always above expectations and there are no challenges for me to continue, however in the interest of business strategic change, they want me to leave starting immediately which includes: 1 month of knowledge transfer (salary will be paid) and 2nd month of lay-off (salary to be paid as F&F in 45-60 days). My boss confirmed that the work I have been doing still requires support and he wants to ensure I stay in the company but cannot confirm anything. I requested my Head of HR to consider this as severance and assist me with a 90-days severance which will allow me to search for a job and accordingly support my family as I am the lone bread winner with monthly expenses in proximity of INR 1lakhs p.m.
Can you please advise how to legally get entrenchment pay-out as I have worked here for more than 2 years - there is no existing policy in our company around severance? They have the culture of firing people with no real causes but I wish to seek legal recourse to support my family and child as GST has really made it a tough time to get a relevant job in such a short notice.
