Dear Friends,
There is a problem..... people in my organisation (in tours and travel)at junior level join, and after training of 2 months when its time to deliver they leave. Pls give solution so that we can keep a check... Is it avisable that we keep 1 original certificate of candidate and after completion of same time say 6months we return.
Pls suggest.

hi preeti
It is the first thing that you have to check the attitude of the candidate who is going to join for training.
know the commitment level from the candidate side by posing some questions...!!!!
Now a days aspirants are not interested in producing certificates or writing bonds.

Dear Ranjith, I want to know is it legally fine if we take certficates and mention in offer leter. Pls help, Preeti

Hi Preeti,
Legally you can not ask for original certificates or hold the same. If you mention it in the appointment letter, you are actually putting yourself at risk.
Sanjeev's suggestion of charging them for the training and refunding that money after 6 months or a year is a good one. Alternately, you can hold their salary for the training period and another 3-4 months thereafter to ensure that they stick with you.
That way, you can keep them from leaving. Another option of course is getting them to sign a bond for six months or one year for salary for the same period, so if they leave before, they have to pay you that much amount.
Hope you find something useful in my suggestions.

hi preeti
As mr. Gaurag expalined it is not possible to include such kind of things.
But it would be better you not take such options like holding their certificates which make create problems as i have seen with one of my friends company.

Dear
Bond cannot be collected as Management has to incur special expenditure for training like sending the person abroad . In your case in the trainining process the Co will also derive benefit of the Trainees work .
Holding Original Certificates .Unethical practice. It may involve Criminal Act if a Police Complaint is filed.
Deferring payment of Salary it is violation of Payment of Wages Act.
End result it is part of Business risk and you will have to find out a commercial solution of retaining your trainees by offering the an attractive package aftr completion of the training process.

Preethi,
The above recommended ideas look good. Please put this also in back of your mind that you should develop an effective policy in this regard before you implement any of these recommended ideas as solution to your problem. Please also note that all the policies and procedures must be incompliance with the local labor law and the existing policies of the organization.
