In case of death of an employee while working in office. what kind of benefits a company provides to the employees family. And what are the policies develop by the HR regarding to death of an employee which are mandatory under the companies Act ?

Dear Rajesh, you have not mentioned whether Natural Death or Accidental Death arising out of and in the course of Employment.Further, you have not mentioned about Labour Laws applicable to your Establishment.Please go through companies Act ? Please update your knowledge before formulating Policy
For Death while in Service, Following are Payable:
1.Gratuity under The Payment of Gratuity Act
2.EPF- If Employee is covered under EPF
3.EPS- Pension to Spouse & Children under EPS, 1995
5.EDLI Benefits-to Nominee under EDLI
4.ESI- Funeral Benefit to Family under ESI Act, 1948

Companies Act is not dealing with compensation to employees for accidents. It comes under Employees Compensation Act or ESI Act.

Hi RAJESH KOUL,

Though you have not provided sufficient information like cause of death, duration of employment etc, still the best answer would be based on my guess that your company is meeting all the compliances, the nominees of the worked are entitled for pension from provident fund department including the children below than 18 years till they meet this age criteria, claim of provident fund to the nominee can be done, funeral expenses of the deceased employee from ESI.

If it was a death on work then the company have to pay the compensation as per Workmen compensation act 1923. The amount of compensation to be paid depends on the nature of the injury and the average monthly wages and age of workmen and it would be decided by the assistant labour commissioner of your area. Hope you have take WC policy and informed the labour department about the death.
