if employer is not registered in esic so ,what her employee get the benefit of maternity act or not?

Dear Anonymous,

Benefits under the Maternity Act have to be provided to female employees as per the Maternity Benefit Act, if ESIC is not applicable to the organization or if the female employee is drawing wages more than the ceiling limit of ESIC.

If the Maternity Benefit Act, 1961 is applicable to your establishment? only then Woman Employee is eligible to claim benefits provided therein

The Maternity Benefits Act applies to all organizations in the country where 10 or more employees are employed. The act applies irrespective of whether the unit is covered under ESIC.

If ESIC is applicable, maternity benefits will come from ESIC for all employees who are covered. For all other women employees, the employer is liable to pay maternity benefits.
