Hi,
I am really confused that what is the difference (Particular to "Notice Period") between the employee in probation Period and after confirmed in a company.
I am an employee in probation period in a company.
when i try to move out from the company in short notice, they are asking me to give notice period as like confirmed employee.
Do i have rights to buy notice period in that case?
What should I do, if employer is not accepting when i am ready to buy the notice period?
Do i have rights to go legally?
Please help me "this issue eating up my mind"

hi,
When an employee is in his probation period den he/she doesnt hav to give any notice period. when he/she gets confirmed and signs the appointment/confirmation letter entails these conditions about notice period while leaving den he/she gets legally bound by dat otherwise not.

Dear Pardass,
Policies pertaining to Notice period during Probation or Confirmation varies with each organisation.
As fas as I am aware, most of the companies have no notice period during probation but in many companies they have a time period fixed.
So, for all your queries, I suggest that you should refer to your company policies and if the management is asking you to do anything apart from those policies then you are not legally bound to do so.

Dear all
Please do not be under the mistaken impression that there is no notice period for a probationer. It is only for the Employer who need not give a Notice to terminate. If the Probationer wants to leave he is bound to give adequate/ sufficient notice or make good payment in lieu of Notice. Adequate/Sufficient is the time required to find a replacement .
If no notice period is provided in your Pobation Contract ,You can submit your resignation and offer 15 days pay in lieu of notice and see their response,if they do not agree improve it to one month and still if they dont send One months Notice pay and take alternative steps thereafter.

Hey Friends,
All of you are making us confused. Please confirm whether a probationer will have to serve his/her notice period or not. Some people are saying that employer can terminate the srvices of the probationer without any notice. Some people are saying that employer and probationer both can terminate the services without any notice.
Please suggest the clear answers so that we can take the steps accordingly.

There need not be any doubt. Probationer has to serve reasonable notice.This for the Employer to make alternative arrangements. Notice is a pre requisite for diplomatic severance.

Dear,
Notice period for probations and Confirmed employee varies from company to company. Serving notice period is not a mandatory clause for probatioers or confirmed employee(I am not aware of any any act on the same, if there is any then pl correct me).
We are a very large company with all India persence and we dont have any clause for notice period for probationers.
Therefore, notice period for probationers is not a mandatory clause if not mentioed in the appointment letter.

Hi,

Thanks for the response but i am still not very clear

In my offer letter, they haven't mentioned any notice period for specific to probationer or Confirmed one.

But some where they have mentioned 2 months notice period without saying that whether it is for probation or confirmed.

I was discussesed with some other company employees and decided as per the common company polices in india and accepted new employer offer.

Once I put resignation, then they said these 2 months for all(Probation as well Confirmed)..*so here my question is what is the difference between probation and confirmed one?*

Even I have serviced 10 days and handed over the responsibilty properly

They stopped my last month salary + 8 days notice period

They said that they cannot give anything at last working day (resignation acceptence letter, relieaving letter, experience letter and full and final settlement)

I ASKED THEM ATLEAST FOR EXPERIENCE LETTER (Badly i need it for immigraion purpose) EVEN IF THEY ARE NOT READY TO GIVE ME SALARY etc..

I strongly belieave that *There offer letter is not clear about this*

Please let me know if they finally refuse to give anything, can i file a case aginst them or is there any other possibility ?
