Hello, Our company is having a R & D setup in U.P and employing over 60 permanent employee and over 100 CL on various outsourced services like housekeeping, security, maintenance etc. No commercial production of goods and services is done at our site and no sale is done from our premises & hence we are not covered by Factory Act.
We are undertaking new construction in the complex. Does BOCW Act is applicable to us. Does the liability to pay Labour cess lies with us directly or the Civil Contractor can deposit on our behalf as we have given him the contract for the job.
