How can we pay only minimum wages (including leaves with wages, wages for weekly offs rest and holiday with wages) to contract labours every month
Dear hr professionals and seniors if contract labours have worked 24 days and taken 5 weekly offs and two festival holidays 11.10.2016 and 29.10.2016 in october 2016 do we need to write maximum working days 24 or 26 or 30 or 31 in contract labour registers under clra act 1970? without loss of pay how many days can we give leave to contract labours excluding 5 weekly offs and 2 festival holidays in october 2016 or every month? as per ap rules minimum wages for unskilledrs.7944 per month semiskilledrs. 9377 per month skilledrs.11509 per month highly skilledrs.14357 per month for calculating daily rate of wages we are dividing that above minimum wages by 26 if we write no. of working days 30 or 31 including wages for weekly off rest festival holidays it will exceed above minimum wages if we write no. of working days 26 excluding weekly off rest but including festival holidays it will come exactly minimum wages because we are dividing by 26. for i.e: example 1 category: unskilled labour no. of working days including weekly offs and holidays in october 2016 31 per day 7944 / 26 305.5384615 per month per day wages x no. of working days 305.5384615 x 31 9471.692308 say : 9472 but we need to pay only minimum wages rs.7944 but it is coming rs.9472. how we can correct this things? example 2 category: unskilled labour no. of working days excluding weekly offs and including holidays in october 2016 26 per day 7944 / 26 305.5384615 per month per day wages x no. of working days 305.5384615 x 26 7944 it is coming correctly minimum wages rs.7944 we need to pay only minimum wages every month including leaves with wages wages for weekly offs rest and holiday with wages not more than above minimum wages for your quick reference we have attached contract labour andhra pradesh rules 1971 please find the attachment copy and please clarify above things thanks with regards thirumurugan

As there is no prescribed law for calculating wage for workers pls advice about the following. want to calculate wages for workers in the following way pls suggest whether there is anything wrong as per law or not: suppose monthly wage of a worker 10000 rs. consider january month total days in a month 31 days weekly offs 5 absent 1 paydays 3151 25 calculation 10000/ 31 525 9616. the same way we want to calculate for all months. is there any issue with the above?

Hello friends i am having a big confusion while working out the salary for workers based on central minimum wages act. till last month we used to pay the state government wagestamilnadu to our employees where the basic da given for entire month. it also mentioned that to get the daily basic/da we need to divide the amount by 26. from november onwards we got a policy to pay the higher of the central/state wages to the workers. here come to the central wages the basic and da given on daily basis i.e for one working day. the main confusion here is that to work out the monthly salary whether we need to take 26 days or do we need to include weekly offs also? kindly help me. regards m.girish.
Treating weekly offs as lwp
Dear friends we are a pvt ltd. co. we have 5 days working being saturday and sunday as weekly off. in our organisation if a person doesnt have leave balance and remains absent then same is treates as lwp which is normal practice everywhere. now if i exhust all my leav by thursday naturally friday will be loss of pay for me i wont be attending office on saturday and sunday both being weekly offs and if i resume on monday still my absence for 3 days i.e. friday fair and acceptable and even 2 days weekly offs will be treated as leave without pay and salary will be paid for 3 days less. is it legally allowed? or since i resume on monday saturday and sunday should be treated as weekly offs and only one day i.e. friday to be treated as lwp. you can mail to me on img thanks regards pari
