Hi everyone myself Abhishek Tiwary working in IL & FS group in Jharkhand can anyone please tell me how to calculate and deposit half yearly return and due date please share the calculation format if any.

Dear Mr. Abhishek,

The Half Yearly Return is applicable under Contract Labour (R&A) Act, 1970. Every contractor who has obtained the Labour Licence udner the Act, is bound to deposit the Return.

The period for the Return is from (Jan to Jun) and (Jul to Dec). The contractor is supposed to deposit the Return to the concern labour office within 30 days of ending the period.

The calculation is made (in r/o manpower deployed at site) for the period regarding:-

Days worked (by the PE and by the Contractor),

Maximum No. of menpower deployed at site,

No. of mandays worked at site, ,

Wages paid to the contract labour etc.

The considerable point is if you are prime contractor and have obtained Licence in r/o all labour (security, gardening, technical, housekeeping) than you need to calculate the data in r/o all the menpower.

Mr. Singh has provided you very useful proforma but CLRA 1970 needs more compliances, you may either go by the Act or may avail our services related to Labour Laws anywhere in Jharkhand.

Thanks sir for your attachment my question is if total number of worker is 22 and number of working days 151 than mandays will be 22*151*8=26576/8=3322 is right multiplied by 8 because of 8 hour working.

Dear Abhishek,

While calculating mandays why you are considering 8 (which denotes the Hrs).

Further this is not the right way to calculate the mandays for Half Yearly Return.

Only the days for which worked done by men (employee) are countable for mandays. The w/off, holidays, Leaves etc will not be countable. In your above calculation you have straightway multiplied the Monthly working days with No. of menpower deploy at site. The Holidays, leave need to be excluded.

You need to take the attendance for the period in r/o the contractual menpower at site. Only consider the "P" (Present) days every month and make a total of all six month.

I am attaching some formats (attendance and data related calculation sheet) which will help you to calculate all the contents required in the Return.

However, keeping in view the repeated posts related to queries of Half Yearly Labour Return, I will separately post a discussion in which same will be shared with fellow members.

In many establishment the Return is being integrated with reporting system or with software. In such cases the Return is being auto generated as per integrated data.

But in some establishments it is being done manually (self made calculation). the format will be useful in such cases.

Experienced members can put more light on the matter.

Thanks Pan Singh Sir for your clarification in attached format in above in 151 I will exclude holiday and leave,w.off etc consider only P I read some where that for mandays calculation you have to multiple total number of worker* total number of present days*8/8 as we not show OT hrs

I would like to request you that, i have to submit the half yearly return on the ending of June 2017 and i need a confirmation that our on-roll employees man days & wages will be included in this return or not.
Can anybody help or give your positive suggestion in this regard.

I need the clarificaiton.
There are about 11+ forms under CLRA our business is most complexe were we have huge contract head count under which only few premises under CLRA head count thresh hold limit.
I want to know we have to maintain and establish specific to the CLRA lincnsed premises these forms. Please clarify.
We have about 800 contract employee which we are providing to the principle employer as per our business agreement and we have 2 location having the CLRA thresh hold limit and we have obtained the license. We need to know the updated latest forms under CLRA for lincensed locations

Is bound to deposit the Return. and in Central Minimum Wage only Annual Return is mandatory or Half Yearly Return is essential is sharm suvidha?
