Notice period within probation period
Hello i have some query related to resignation in probation period. i have served 30 days notice in my company and after my resignation they dint replied as they told me our boss is not here and he will resume after a month and just before 2 days on completion of my resignation he came and hr had put me a mail that as per offer letter you will have to serve 2 months notice period so you have to extend 1 month. as written in my offer letter: 1. within first 6 months we reserve a right to terminate you if your work founds unsatisfactory. 2. after 6 months 2 months of notice can be served either company or employee 3. once employee is permanent notice of 3 months can be served from either side. my queries : 1. as per above mentioned terms i am confused how much notice period i should submit.? 2. is it true an employee on probation period can leave within 3 days serving notice?
Removed the employee form company due to loss
Dear all my name is sudher .working in private organisation where some staff had removed directly without any notice or compensation for company loss so we want to know we have any right to file case in labour court for direct termination without any notice and as i am aware if any comapny is in loss and there wants to reduce the staff and there must give the three months salary with the settlement...confirm whether my correct let me know
Query regarding notice period from employer / employee
Dear all i am going to join a small it firm where i noted strange notice period option. it is like 30 days from employer and 60 days from employee. also it s not clarified on offer letter that whats employee side notice period and employer side notice period during probation period of 6 months except that it has been mentioned that it can be terminated any time during probation from employer which does mean 0 days notice. but i was verbally informed that it would be 30 days from employee and 15 days from employer as notice period from employer. my questions as below > 1. is this common to follow such different notice periods for employer / employee ? is it legally valid and how often such cases are noticed ? usually as i understand notice period is same for employer as well as employee. 2. should i ask employer to match notice period as same i.e. either 30 days or 60 days for both employer and employee or does it give wrong impression and message to prospective employer ? 3. should i ask employer to correct offer letter with probation period notice details ? please clarify as soon as possible as i need to send acceptance of offer and start next steps from my end.
Immediate relieving from notice period - what is the liability on the organisation?
We have an employee with contractual period of 5 years. he has completed 3 and half year. due to some reason he has been given a notice period of three months by the organisation as endorsed in the contact of appointment. now after 20 days since he was served with notice period he comes and request to be relieved with immediate and salary of the rest of the notice period 2 months and 10 days. the query is a on his request if the organisation relieves him with immediate effect what is the liability on the organisation does the organisation have to pay salary of balance of the days 2 months 10 days or b as he is giving in writing in a way he is resigning does he have to pay three months salary?
Required notice
Hi folks i have a query regarding the notice period when an employee resigns. an employee working as a web developer from past 13 months with us. he submitted his resignation on 28th of february. since he is the only person working as a web designer and carrying out ongoing projects in the organization therefore the employer wants him to serve two months of notice to recruit and knowledge transfer to another person for the same post. however in the employment contract the minimum notice mentioned is 30 days. so is it illegal on an employer s part to ask for 60 days of notice depending on the situation? please help me out here. thanks in advance
Can an employee covered under esi and admitted in hospital for more then two months be removed from service
Dear all can an employee absent without leave and taking treatment at esi hospital be removed from service. what is the right of employee in this regard? we have a case wherein a casual employee reported for duty after four months with admission and discharge slips of varying period and not continuous. thanks
