I m currently working as a store assistant in manufacturing company from last 2 years. This year company is not giving salary hike, and I also didn't get from last 1.5 year.
And now we are about 25 to 30 employees start strike for salary hike, and he fired all thru only send a WhatsApp msg. What can we do against him.??

Dear Mr Nayanvadher, in a concerted manner all of you have gone on Strike & subsequently Employer Terminated your Service. The action of going on strike will be held as illegal. you all could have Discussed the matter with the Employer & Labour Department Officials.Please approach Concerned Labour Department immediately & resume work without any further delay. with regard to Salary hike the matter can be discussed & sorted out

1. Legally you are still an employee in the service of the company. Go to attend the duty and when they refuse you employment, approach labour department fwith grievance.
2. Hire an advocate who takes up service matters or go to a union.

As far as legal terms concern you are still employee of the organisation. No whatsapp communication can be consider for termination of employee. But on the other side strike which was called out by you guys is legal or not. For any strike did by employees or union has to follow certain norms to fall under legal strike or else it will be illigal strike and employer may take appropriate action.
Request you to take help from some advocate with corporate law / labour law background.

2. It purely depends on individual performance and organization's financial growth.
3. Strike is illegal and it can attract punishment including termination also.
As per my point view performance of 25-30 employee can not be same and for one objective how all staffs went on strike. If someone is not satisfied with the current salary he has all the right to leave the company and explore new job.The act which has been demonstrated by your staff is not good at all and if you think from management point view they have taken appropriate action to arrest this issue.
As per whatsapp message is concerned it is not authentic as per the law. But management has cleared their intention. It is advised to go for a healthy discussion with your management and try to solve the issue.
