Hi,
I have resinged from my previous organisation on 2nd may 2017. I have received Resignation acceptance mail with last working date by my manager on mail but HR has not send me a Resignation acceptance mail or Last working date confirmation mail. My new employer would require Resignation acceptance mail or last working date confirmation mail from previous company HR only. My new employer does not accept mail from my manager about last working date. Neither previous company HR sending confirmation mail as its againt their policy as HR said Nor new employer accepting confirmation mail from my manager. Kindly Help me to come out from this issue. If there any law for that kindly tell me. Kindly reply on it priority.

Hi, I don't think it is big issue, you need only reliving letter only from your last employer which you can give to your current employer with your manager resignation acceptance mail, if your current employer ask for the resignation acceptance for HR only then talk to your last employer HR or his senior, reliving letter or salary slip is enough proof to join new company.

You cannot avoid producing an all clear Relieving Letter from your previous employer. Get it at any cost.

Dear Suraj,
As per applicable labour laws, particularly in the Factories Act only two designations are recognised i.e. Factory Manager and Occupier. If your resignation is accepted by the Factory Manager, then their is no need to seek the similar acceptance from your HR.
Any clearance letter can also be arranged which may be required at new location.

Dear Suraj,
What is the Notice period as per the Appointment Letter? It is admitted that you have submitted your resignation on 02/05/2017 which has been accepted by your reporting Manager, but not by the "Appointing Authority" who had issued Appointment letter to you.
Did you receive Appointment Letter by Mail? No you were issued hard Copy duly signed.Complete your notice period as per the Terms of appointment. You will be issued with Relieving Letter from the Authorized person which will suffice your concern.
have you fulfilled Notice period Clause as per Law, if yes definitely you are entitled for Relieving Letter

Technically, legally the appointing authority shall be the authorised officer/authority to accept the resignation also. Your HoD shall have only the recommendatory powers to forward your resignation letter with his recommendations. He also not authorised to issue a 'Relieving Letter'. Your new co. is right in asking you to produce the RL from the HR. I would suggest you are racing against time. Before you should panic better solve any problem pending with your previous HR and try to obtain the valid RL and happily join the new co. to start a new career.
