I am working in Pvt. Ltd company company. Which is deducting PF and ESI from my salary and company is eligible for taking tender of center and Delhi govt.
Now minimum salary has been increased In Delhi, but according to our company. We are not covered by Delhi govt. Minimum wages act. Is it possible a Delhi bases registred Pvt ltd company not covered under wages act.
So please guide me.

Minimum wages is not based on Constitution of Company like Limited, private limited Partnership etc Please let us know the nature of activities carried on in the Establishment? is it a manufacturing concern.Your question is not clear/

Our company is ISO, URS and UKAS certified . it provide AMC services for computer, network and provide manpower in govt. organisation like attendant, help-desk and engineer.

as far as I know, Minimum wages are applicable as per STATE minimum wages declared by the authorities. Thus you are entitled for the same, but there is stay in the court against new minimum wages for delhi. Till the time court judgement comes out, the new minimum wages are not applicable to be paid by the organisation.

From the information furnished, it appears your Company is registered under Shops & Commercial establishments Act. Minimum Wages applicable for your Company is Shops & Commercial Establishments.Every Year i.e on Financial Year basis April to march minimum Wages is increased based on CPI.
The state in which your Company is functioning is Delhi? if so Minimum wages applicable for Shops & Commercial establishments is applicable to your Company.All Establishments who fulfill the conditions of Tender can apply for either Central/Delho Govt Contractors. it appears your company is in to supply of manpower on contract basis for Housekeeping Security etc.
please find out whether you are getting less than Minimum Wages are more than minimum wages ?

Please help me.....In continuation of state Govt Notification regarding increase of Retirement age from 58 to 60, please confirm whether we require to continue to pay Employer’s PF contribution of 12%, whether we need to stop the Pension to employee.

If you are posted in Delhi, you are covered under Delhi minimum wages in case your position is covered under the said notification. Moreover you have not mentioned the location of posting. If you are posted in some other state, the minimum wages of that state would apply.

Need suggestions on many Indian companies don't pay minimum wages as per wages act to own employees, but they shows increase salary on Their salary books because to safe himself for future inspection and companies make fools innocent employees and they can't avail EPF benefits. How can we aware people/employees etc.about this discrimination
