Confirmation appraisal - appointment letter company clause
Hi i m very confuse about one clause of our appointment letter. as per the appointment letter of our company clause "your services would be eligible for confirmation appraisal at the end of the probation period." shall we increase salary of employees after confirmation.
Can they force me for a notice period without any clause during probation time?
Hi all i joined an it company in august and due to improper role alignment and i am not able to fit to the role i want to resign now i have bee working in this company for 2 months now and am on probation period can the company hold me for a notice period during probation period? my offer letter states this: probation/confirmation: you will be on a probation period for the 3 months. based on your performance your services will be confirmed with the company in written after 3 months. after confirmation your notice period will be for 3 months on either side. can they force me for a notice period without any clause during probation time? urgent help needed?
Regarding new offer letter notice
Hi all i am working in sw company in india.i got a new offer letter last week from another company and they had mentioned in terms and conditions like "you will be on probation for a period of four months from the date of joining which may be extended if considered necessary by the company at its discretion or based upon your overall performance during the probation period. during the probationary period your service can be terminated with one month notice or salary in lieu of such notice on either side. upon successful completion of your probation you will be advised in writing of your confirmation as a regular employee of the company. on confirmation your services can be terminated upon three months notice or three months salary in lieu of such notice strictly based on xxxx pvt. ltd. managements decision." here what is meant of 3 months of salary in lieu of such notice. couldnt understand this .> it means do we need to pay the whole ctc amount for 3 months or the basic pay of the remaining days. kindly give an update on this.
Offer letter: termination clause not applicable for probation
I am working for a startup company of size 20 from 19th sept16 till now and i have placed my resignation on 11th jan17 and agreed to serve notice period of 45days as stipulated in the termination clause. i just recently found that there is a line probationary clause that says "termination clause is applicable to probation" below is the probationary from offer letter probationary period the employee shall be on probation for a period of six 6 months from the date of joining. the company shall be entitled to forthwith terminate the services of the employee and this agreement at any time during the probation period. the company may in its sole discretion extend the employees probation period based on the employees performance conduct and/or other factors as the company may deem fit. the employees probation period shall not be considered to be completed unless the employeesservices are confirmed by the company in writing by a letter of confirmation. the provisions of clause 10 shall not apply to a termination under this clause. probationary period does this i mean legally i am not obliged to serve notice period?
Relieving - before confirmation
Hi i am working for an organisation whcih as per policy is to provide confirmation after 6 months based on the feedback . though i got a positive feedback from my supervisor i am still waiting after 10 months for my confirmation . every time i talk about the same they will find some issue to postpone the same one some pretext. i have finally put in my resignation letter with a date but is it possible to leave the employment before the notice period as i am not a confirmed employee.
What parameter being hr can use for check employee performance
Respected senior i require you value able advice in the matter of performance appraisal. in our company one employee joined 07july2016. as per his appointment letter his confirmation date makes 06jan2017. but his hod extended his confirmation for next 06 months. as per his personal record he always come on time and did not take much leave and we did not receive any complaint against him. but his hod found his performance not found satisfactory. my all question as per under. q: 01 so being the hr how we can identify his performance? q: 02 what kind of parameter hr can use to check his performance? q: 03 some time many disputes arise between the hod & employees so we should trust on hod or not? i need it on urgent based. regards gaurav mehta
