Calculation of total number of years - gratuity act 1972calculation
Dear hr aspirants this is shekhar working in an automobile manufacturing at noida. from the extent of gratuity act 1972 i am a bit confused over calculation of gratuity suppose if any employee completed 8 yrs 6 months and 0 days in continuous basis than how do i calculated the total number of years of service whether i should consider this as 9 years or 8 years ? pls comment

Hi all warm wishes and hope every one is doing well.. well i have a confusion regarding the gratuity payout to some one who leaves a employer after 6 years. suppose rs." gd" is amount deducted annually 4.81 per year. so with no increment the total gratuity deduction will be rs. "6xgd" . after 6 years he left the comp and the gratuity calculated as per act will be rs. last month salary drawn/26 x 15 x 6 years . now my question is " is the total gratuity payout includes the total deduction done in 6 years i.e 6xgd or it will be added to the total payout calculated. kindly help me on this.
Eligibility for gratuity - the break period will not be considered for service for the calculation of gratuity?
Suppose the employee is on the company s rolls till the date of resignation. in that case the total period from the date of joining to the date of leaving will be considered for service to calculate gratuity; if any break is between them the break period will not be considered for service for the calculation of gratuity. once you have completed five years of continuous service in the company without any break in service you are eligible for gratuity. gratuity calculation: last salary drawn pf deductable salary basicdasp.allowance/26 days 15 days for every completed year of service 15 days of salary will be calculated as gratuityand if the service is more than six months then one year will be added in service no of years of service after 5 years of continuous service
Clarification required on gratuity
Hi friends i come to know recently when i was recruiting one candidate to our automobile industry that... he received gratuity for his service in that company for only 3 years. this person has finished only 3 years service in that company instead of 5 years of service. please clarify me: is there any other companies which are paying gratuity even for 3 years of service. and also please let me know the new amendments if any about gratuity. request you to respond thanks & regards vishnu 09867348720
Question on gratuity
As per the indian gratuity rules a person needs to complete 5 years with a company. suppose a person joins a propreitary company which does not provide for gratuity.. after 4 years the company becomes a pvt ltd and starts gratuity.. now if the employee leaves after 3 years.. the total service is 7 years but the period under the pvt ltd is only 3 years.. will the employee be eligible for gratuity?
