Maternity benefit (amendment) bill 2016
Friends pl find attached maternity benefit amendment bill 2016 introduced in rajya sabha today. the salient features of the bill are: a increase the maximum period of maternity benefit from the existing 12 weeks to 26 weeks in case of women who have less than two surviving children and in other cases the existing period of 12 weeks maternity benefit shall continue; b to extend the maternity benefit to a "commissioning mother" and "adopting mother" and they shall be entitled to 12 weeks maternity benefit from the date the child is handed over; c to facilitate "work from home" to a mother by inserting an enabling provision; d to make it mandatory in respect of establishment having 50 or more employees to have the facility of creches either individually or as a shared common facility within such distance as may be prescribed by rules and also to allow four visits to the creche by the woman daily including the interval for rest allowed to her; e every establishment shall intimate in writing and electronically to every woman at the time of her initial appointment about the benefits available under the act. thanks

Dear seniors is it legal if employer put restrictions on maternity benefit upto 2 children only. becasue there is no any such provision in maternity benefit act for such restrictions. thanks inbanticipation....

Maternity benefit for employee on probation dear seniors i would like to know if maternity benefit could be given to employee on probabtion. actually one employee has joined us in aug.09 and now she is asking for the maternity benefit is she eligible for the maternity benefit as she is on probation period and she is supposed to take leave during dec.09. according to maternity benefit act : it says a women shall be entitled to maternity benefit only if she has actually worked in an establishment of the employer for a period of not less then eighty days in the twelve months immediately proceeding the date of her expected delivery section52 now here it is mentioned 80 days in the 12 months. seniors pls. guide me with regards deepmala

Dear all i have one question in relation to maternity benefit act as per maternity benefit act leave is allowed for 12 weeks. 6 weeks before delivary and 6 weeks after delevary. but if a women extended her leave for more than this period then what is the provision under the act is she eligible for the payment for those days? and how much days she can extend her leave? thanks & regards kranti jadhav

Dear all as per which act should i comply with to calculate maternity benefit.? i am confused a lot between these two variations. which one should i follow.? "maternity benefit act 1961" section 5. right to payment of maternity benefit. subsection 3 the maximum period for which any woman shall be entitled to maternity benefit shall be 26 weeks of which not more than 8 weeks shall precede the date of her expected delivery: "andhra pradesh shops and establishment act" section 25. maternity benefit. every woman who has been for a period of not less than six months preceding the date of her delivery in continuous employment of the same employer whether in the same or different shops or commercial establishments shall be entitled to receive from her employer for the period of a six weeks immediately preceding the day of delivery; and b six weeks following the day of delivery; such maternity benefit and in such manner as may be prescribed: provided that no woman employee shall be entitled to receive such benefit for any day during any of the aforesaid periods on which she attends work and receive wages thereof.
