Dear Sir/Mam,
I was working in an Company from where i left job before 5 months and after many communication now they are doing my FNF n i m not satisfied by the amount of settlement.
there are the details of my last job
1. i have joined ther on 22nd of feb 2016
2. resinged on 17th oct2016
3. serve 16 days notice period insted of 30 days (i have clearly maintained that in my resignation to them that i will serve only 16 days the y havn't respond to my resignation and my reminders also)
4. hance 5 months over after my resignation and now they doing my FNF n the amount is not satisfactory
5. they deducted my PF but did not deposited it
6. they only providing me my PF amount in cash and 10 days salry against the days i have served to them
kindly guide me for what actually they are liable to do.

Since your notice period was 30 days they must have deducted remaining amount from your salary apart from the notice of 16 days which you already served. With regards to PF amount in cash, couldn't get you kindly elaborate so as to give appropriate view.

Thanx, they are saying that we will deduct whole months salary, and they deducted my pf but did not deposit it till now and now they are giving me the amount of pf in my FNF that is also less then the actual amount of PF.

I am advising as under on the basis of some presumptions;
1. I hope you were given an appointment letter by your employer. The said letter must have the detail about exit clause.
2. You were getting payslip every month.
3. you have given resignation in writing and obtained acknowledgement of the same.
First of all collect your dues from the employer. Without telling/informing anybody go & meet PF Commissioner and explain everything to him. Fill PF withdrawal form and submit the same to him.
PF Commissioner can ask you to give everything in writing, write and give it to him, keep a copy for your own records.

Have they returned Employer share of PF@12% together with Employee Share of PF @12% already deducted from your Salary
As suggested by Mr Bharat, after receipt of amount approach PF Department concerned with all the documents requesting them to initiate appropriate action

Thanks to all of you for advises, i have appointment letter duly singed with salary structure, i have resigned by E- mail, and they did not provide me salary slips, now what can i do in this case, i have send the printed copy of mail regarding resignation and reminders thru speed post to them also.

Dear Members,

We provide solutions/advises to the problem/s query raised by the employee which is one sided. We never knew what are the facts behind it and always consider Company/Employer as defaulters.

Referring to the above matter, the employee has hardly worked for 8 months. He has forwarded his resignation by email, he didn't feel that he should submit hard copy of his resignation to his Superior. He mentioned that he has given 16 days notice is false. He worked only for 10 days and remained 6 days absent during his notice period. Under the circumstances, what he expects from the Management.

Now a days most of the employees consider that once they secure employment elsewhere, submit resignation with some notice period, their job is over, they don't have any responsibility and or accountability towards the organisation, where they have worked or working. They do not understand that because of their leaving the job the organisation has to make arrangement for another person in his/her place and sometimes find very difficult to get the right candidate. This may be one of the reasons the HR / employer get irritated and tries to make the leaving employee also to face some hardship.

We do not know the salary of the said employee and whether he was a member of PF. If his Basic salary is above Rs.15,000/- there are rare chances of his having PF Membership. He doesn't have any pay slip with him as a supportive document.

What is understand from his Post that he has collected his Sept. 2016 salary, submitted his resignation by email on 1st Oct. 2016 night after receipt of salary and given 16 days notice and during notice period remain absent for 1 week. Naturally, no organisation will favour such employee, who doesn't have courtesy to handover charges and get himself relieved smoothly.

If the Company terminates any employee is unfair labour practice and when the employee quits job without any notice and or some notice is justified?

I have no intention to hurt anyone's feeling but this is the fact.

Dear Mr suresh, the things u said above about me is totally false, why u think only as an employer, there are some reasons why i quit, n i m not from that type of employees who create negative image of their employer in front of others by telling what actually happen, if they are not following proper HR policies that is not my fault how can u blame me and think about me like this i m here for the help not for this type of allegations, for ur kind information i would like to tell u i m not the one person who suffer it their are many more employees of same organisation, difference is that i m not from the type of persons who easily give up
if u r able to guid me and help me out in things, i will feel really great full

Now do the following immediately.

Write a letter to your employer with full details from your joining stating that you joined the organisation on 22.02.2016 as ______. Served the organisation for 8 months and left the organisation on 17th October, 2016 by serving 16 days notice vide your resignation letter dated________.

I regret to inform you that despite of lapse of more than 5 months and my repeated requests, you have not settled my dues.You are hereby finally requested to release my following dues without any further delay.

1. Oct. 2016 salary for _____ days.

2. Unavailed leave encashment for _____ days

3. My Provident Fund Account no. under your organisation.

Yours faithfully,

Cc to : The Labour Enforcement Officer

The Labour Commissioner

Send the above letter with little modification by Registered AD Post and by Hand delivery to the Labour dept.

Similarly

Write separate letter to your organisation regarding Provident Fund withdrawal Submit applications in Form No.19 & 10 B furnishing your bank account details, name & address, copies of IT PAN, Aadhaar Card with Bank Passbook or Personalised Cheque Leaf etc. and mark copy of the said letter to The Regional Provident Fund Commissioner, where your Company has PF registration. This information you need to collect from your co-employee.

Now in this letter your have to write whole thing that you have joined them on ___ as_____ and left service on ________.

During this period you have deducted my Provident Fund as Under:

Send documents by RPAD and hard copy to PF Office by hand delivery. You do not mention that your PF is not remitted. What you have to mention that despite of your repeated request company has not provided you PF Account no. till date.

Please note that you have not yet disclose your salary details and your date of resignation and also whether you have handed over the charge or not. In absence of such details, proper guidance is difficult.
