I have resigned my resignation on 12 Jan, 2017 where my notice period was supposed to be for 60 days but when I sent the mail no one ever replied on the mail and in informal communication they kept on saying that your resignation is not accepted and you should stay and revoke your resignation. Finally, on March 2, 2017 I sent an official mail to revoke my resignation, once I sent my resignation I received a mail after 10 .i.e on March 12, 2017 that my resignation revoke is not accepted as : Backfill has already been hired and we do not have requirement as of now. I sent a mail to them asking for resignation acceptance and confirming my last working day on which they never replied. Since no one was ready to reply I sent a mail from my personal e-mail id asking for explanation which lead me to my meeting with AVP HR and he asked for a day to reply. Later on I got a word from my reporting manager that tomorrow is my last working day and I need to move from the organisation.

Now, as much I know an acknowledgement is mandatory by the employer communicating my last working day. Can anyone confirm that there is any legal ground for which I can file a complaint for this?

My name is Sandeep Srivastava, I was working with Convergys Mumbai since May 2016, however I didn't report to office on 5th Jan 2017, post which my Immediate Supervisor raised a NCNS (NO CALL,NO SHOW) against me and on the very same day texted me to come to office & resign. So I decided to sent my resignation hence I resigned. Post which I got the Resignation Acceptance Letter from the company.

I am trying to follow up with the HR team to provide me with the Relieving Letter and also the Notice Period salary (which is for two months in my case) as I was asked to resign but the HR people are just ignoring this fact and saying that I should have served notice period and as I didn't I have to pay the company the notice period amount post which only my F&F and Relieving Letter shall be disbursed.

I tried to explain them that I didn't resign but I was asked to resign, I also sent them the screenshot of the text message wherein I was asked to come to office and resign by my supervisor, but the HR person seems to be ignoring everything & just singing the same song of paying them notice period amount.

At the time of resignation I was confirmed employee of Convergys India.

Kindly assist.
