According to our HR policy, we are allowing our employees to carry forward 5 PLs to next year from the current leave balance and we don't allow the probationer (6Months) to avail PL but still they can accumulate their PLs and use it later.
Now, the problem is we have 3-4 Probationer who joined before 5 Months. They have 7.5 PL in their account. We have to reset the Leaves for the next year. We didn't allow them to take PL since they are in probation. As per policy they can carry forward only 5 days. Those Employees are 2.5 days of PL.
How to handle this? or suggestion in change of policy? Pl guide.
Note: we are an start-up so we don't have senior HR mgmt ppl.

As per the leave rules no where it is mentioned as PL/EL is to be only on the confirmed employees. Every employee who has worked for a period of 240 days or more during a calendar year shall be allowed during the subsequent calendar year.
As per the shops & commercial establishment act Even Sick leave/casual leave of 12 days are necessarily to be given for 1 year
You need to consider those points for your leave policy

The policy of 5 days' leave carry forward ,in my view, should not be applied to the probationer as he being first timer, is only entitled to it and can avail after his confirmation..
