Dear All, I request all to explain me leave policy. I am looking for more information like how many total leaves can be given to an employee in a year as our company is a Pvt ltd co at Pune and got 30 team members at Mumbai location.
They do not want to give privilege leaves as these team seats at client location. They can't afford 3-4 days leave by any employee. Please guide on number of leaves that can be given in a year except privilege leaves.

Dear Sapna,
The leave entitlement is a mixture of laws laid down under various acts and the company policies defined for the purpose/s.
In most states/industry the CL and SL is depend upon the company policy. However, under the Factory Act the PL is defined as one day leave after 20 days present (except w/off, holidays etc). In addition to the National Holidays, every state declare some compulsory Holidays which need to be comply in the state.
However, in most organisations 12 leaves (5 CL, 7 SL) and 15 PLs (as applicable) are given every year. The accumulation of leave depend upon the company policy. Same is followed in our company.
You can seek some consultant's services in your state. Moreover if there is no defined leave policy in your company. There are professionals who do this at nominal cost, you can approach them.

Please consider, there are 365 days in a year. Out of that 52 weekly holidays gone. Remain 313. Out of 313 days for how many days an employer can afford his employee to stay away from work and yet pay in full. Those days are leave days. That includes Casual Leave, Sick Leave, Earn/Privilege Leave and Paid Holidays. For EL/PL the rule is for factories 1 day leave for 20 days worked. In Shop Act it is 1 day leave for 12 days worked. Sick Leave is given where there are no other benefits e.g. ESI Act, Employees' Compensation Act, Mediclaim etc. which take care of sickness of employee. A notion is 13 months wages for 11 months work. This is 11 months work + 1 month bonus + 1 month leave. The quantum of leave and its bifurcation depends upon the State, Rules, Union, Surrounding practice etc. I am from Pune. Please do not hesitate to call me over phone.
