Dear all members, i would like to know about weekly off. Suppose employee worked in a sunday and he/she would like to apply leave on next month. So can it will be possible to adjust next month.
Formally i'm from automobile dealership, and we have sunday week off, suppose an employee worked on sunday it will adjust with same month absent called 'Weekly Off".
Need help, please reply.

Labour laws have not prescribed weekly off like that. Here there is a mandatory leave in a week. If an employee works on that leave then he is entitled to overtime and a compensatory holiday. This is prescribed both under Shops and Establishment Act and Weekly Holiday Act. So you are entitled to a comp off. This can be adjusted with your absent if your employer agree. But he is under duty to give you a leave.
Generally when an employee works on a weekly off its advisable to give him an off within 3 days before or within 3 days after the day he has worked. Working continuously will bring down the efficiency of the employees.
Thanks for valuable reply, i want to more that he or she can take leave against sunday if working, but if she or he willing to take leave at next month it can be forwarded or may it be adjustable with next month.
It should not be as per the desire of the employee, an employee should be avoided to work on Week off but if due to any exigency of work if the employer and employee mutually decide to get work on week off that should be compensated immediately.
An employee from outstation (Far way) would prefer to work for entire month and go for leave for 5-6 days in the next month, which should not be entertained
From your query I gather that due to exigency of work the employee was asked to work on Sunday - weekly off day.
Weekly off should be made available within 10 days. But also check if there is mention of compensatory off in act applicable to your organisation & decide accordingly.
There is any rules for sunday working, and employee can take week off as per need yourself.
We already run 2 or 3 sunday in a month and give week off to employees, so now problem is that 5 sunday was open and employee want to take week off against ths sunday at Feb 2017.
In these case what need to do, i think so there was such rule for sunday week off alternative.
There is no rule for weekly off working, if due to exigency an employee need to be called for work on weekly off days, it has to be compensated with a compensatory off (General Practice) within 3 days i.e. an employee can work for 10 days at a stretch to the best of my knowledge.
Your above explanation is unclear.
In a month there can be 5 weekly offs. Now if you call employee to work on weekly off day then you have to: OT wages at double rate of wages for non-managerial employee, compoff to managerial employee. Some orgs follow practice of giving compoff to all, but it is legally incorrect to do so.
