Hi Sir,
I am working with private ltd company in HR department one of my colleague left his job after working 08 months with the company but he didn't receive any confirmation letter but his probation period was 6 months .Is he liable to pay notice period as per company policy.
Please suggest me that can i ask him to serve notice period???

If you have not issued a confirmation letter, then he is not a confirmed employee. Only the terms of Probation will be applicable.

If there was any term of notice period in the probation letter, then you can ask him to serve the said notice period or pay in lieu thereof.

As the employee is already working for 8 months; there may be an Apptt.order which will contain the Notice period. That can be followed. c.neyimkhan@gmail.com

What does the probation clause read? If it is mentioned in appointment letter 'unless you are issued written confirmation letter, you will be deemed to be on probation'. This clause is quite common as it protects employer. In such case there is no question of notice period, unless notice is also required to be issued during probation as a term of employment.
