Gratuity in school
Is there any law for not giving the gratuity after completing 5 year of service. my friend worked in a private reputed school in delhi. she resigned from her job after completed 9 year of regular service. now the school management refuse to relies her gratuity amount after 5 months of leaving. they gave the excuse of 6th pay commission. they informed me that it is not necessary to pay gratuity and leave encashment in private school. is it possible? if she want to take a legal action then at what place/department she should file a complaint/suit. can any one advise me for this case.
Employer not setting my fnf after termination of my service.
I worked for an automobile company as assistant manager for five years. they then terminated my service because i was not willing to relocate to a new city as my father is a cancer patient. it has been three months but they have not settled my fnf yet. even before i was terminated they were paying only 50 of the full salary for several months. as a result i am facing accute shortage of money to help my bedridden parents and to pay the school fees of my children. so much so that i had to admit my children in a government school for i could no longer pay the fees of a private school. i have defaulted on my loans and my score is gone extremely bad. what do i need to do to force the company to pay my dues. kindly let me know if i am eligible for gratuity.

My wife worked 12 years in a pvt school in west bengal. she was absent for 2 days due to injury in leg for the reason theprincipal terminated her job and did not pay current month pay . can she claim current month pay termination compensation and for 12 years of service. she is a p f employee for 11 years.the school was appointing every year on contract basis for one year .will this be a problem in claim of gratuity
How to follow termination pay procedure ?
Hello i am working in private software firm since 5 years in india. recently my company owner suggested me to get separate from company. so i am confused about whether to follow official resignation process or consider this as a termination ? if i considered as a termination then can i ask for the termination pay ? as he didn t fired me how termination pay is calculated and what is the next step should i take if he denies to give ?

My company terminated me because of 19. i have lodged a complaint to the mumbai labour commissioner about nonpayment of any severance pay. i have not given any noc to the company but they have transferred the full and final payment to the salary account. they have not given any breakup of the payment but from the amount it is understood that it is the last month s pay which was on hold some loose change possibly from leave encashment etc. the labour commissioner has still not responded to my complaint. i want to have a hearing from the government on the case because i think the termination and nonpayment of severance is illegal. should i return the f&f to the company? should i mail to the company hr that i don t accept the peanuts they are giving to get rid of me? i lodged the complaint before the payment and i don t know when the labour commissioner will respond. i only have a complaint number from the online portal.
Termination of employee - can labour officer send notice to school?
We are having an clerk in our school. he had done theft in our fee and not deposited the same in bank account. he also given us the acceptation letter that he had done the theft in account. now he had done complain in labour law to re joining at our school. kindly advice that can labour officer send notice to school or education dept will do the same.
