Hi, We opened a security agency about an year back and we registred for esi and pf. Things were going quite well, however, due to some reasons we are keeping our business on hold for about 4-5 months and the previous contracts are also cancelled.
Now, since there will be no business all the employees are joining other companies with their settlements from our company. It is for sure that, we will start our business after 4-5 months wilth better strategy. in the meantime, since there will be no employees, we will not pay the pf and esi, so, will our pf and esi licence get cancelled? if so, is there any way we can request the esi and pf authority to not cancel our licence? please help. thanks.

1. Sir, ESIC authorities do not cancel any Code Number etc.due to non-compliance or non-submission of any information or returns. However, if such authorities will see that the employer has not made compliance under ESI Act, 1948, then they can make adhoc assessment under section 45-B of said Act for the period of non-compliance as per their records. It will be more better if you may inform the said department on the same lines as you have mentioned in this thread and request them to treat your unit as temporarily closed.
2. You can request the said office that as and when you will again employ any person, you will again make compliance accordingly on the same code number. I think, you will also be required to produce all records of your establishment before above authorities for ascertaining the facts as may be mentioned by you.
3. I think, you can also inform EPFO authorities on the same lines as mentioned above.

You need to send an intimation to the PF and ESIC offices regarding closure of business.
However, you need to continue filing returns every month till the business is revived.
You need to file the returns online for those who are leaving and the system will automatically records that you no longer have any employees

if self side initiative has not been initiated by employer towards exit of members and intimation of stop of business and zero employment to both departments, then department will go for adhoc assessment always.

AS FAR AS ESI IS CONCERNED IT IS MUST TO SEND A LETTER EVERY MONTH STATING THE TEMPORARY CLOSURE OF YOUR UNIT AND ON STARTING TO GIVE INFORMATION THAT YOUR HAVE STARTED YOUR UNIT AND REMIT THE CONTRIBUTION THEREAFTER.

AS FAR AS EPF IS CONCERNED, YOU HAVE TO PAY THE MINIMUM OF RS.100/- i.e IN A/C NO.2 RS,75/- AND IN A/C NO.22 RS.25/- HAS TO BE REMITTED EVERY MONTH ALONG WITH A COVERING LETTER ADDRESSED TO THE REGIONAL COMMISSIONER CONCERNED STATING THE TEMPORARY CLOSURE OF YOUR UNIT AND ON STARTING YOU HAVE TO INTIMATE AND REMIT THE REGULAR CONTRIBUTION THEREON.

IN CASE OF PERMANENT CLOSURE OF YOUR UNIT, YOU HAVE TO CANCEL ALL THE LICENCE YOU HAVE SUBMITTED TO THE DEPT. AND SEND A LETTER TO THE DEPT. REG. PERMANENT CLOSURE. YOU HAVE TO FACE THE INSPECTION AND REMIT THE BALANCES OF CONTRIBUTION ALONG WITH INTEREST AND DAMAGES DUE TO THE DEPT. AND THEN ONLY THE EPF & ESI LICENCE WILL BE CANCELLED.
