I worked in a real estate company "XXX" in Gurgaon from May 2016 to August 2016 as a Senior Relationship Manager. I was assigned to the Bhiwadi team at XXX. I began on 1st May 2016, but they did not provide me with an offer letter or a joining letter. The company has not paid my salary for the last 3-4 months. When I inquire about my salary, they make excuses and claim they will pay it next month. The company has not established any HR rules but is attempting to extract work from us in various ways. It was simply a waste of my time and position at XXX. Can someone please suggest what I should do? Are there any laws protecting employees' benefits?

Simply draft a letter and send it to your employer stating that your wages are pending and he must clear the same with immediate effect. Send this letter to your employer through registered post. If, within 7 days, he does not dispense the money, contact your area labor inspector and lodge a complaint for non-payment of wages. Also, contact the area PF enforcement officer if PF is not deposited; they will also address your complaint.
The matter can also be covered under section 420 of the IPC. Therefore, you can go to the police station as well.

As per the Payment of Wages Act, the payment date should not exceed the 10th day of the following month. Hence, you may have a case. Were your attendance records being maintained anywhere? Have you received any reimbursement by signing a voucher? If the answer to either of these questions is yes, you have a case.
