Does Interns hosted by a private company come within the Apprentices Act, 1961?

Not every kind of company is covered under The Apprentices Act, 1961. The Industry must be indulging in "Designated Trade". The Following are the designated trades :-
List of designated trades for Trade Apprentices:: Directorate General of Training (DGT)
So see first that they are covered here.

Interns are not apprentices
Apprantices are from specific industry only and the number, stipend and number of conditions are governed by the apprentice advisory of the government. You need to follow the procedure, register with him and then recruit in line with his approval.
Apart from that, an a-Pranit do program may also be provided for in the certified standing orders

There does not need to be a case law. The apprantice act is pretty clear on who can be an apprantice
