Dear Mr. PC Agrawal,
Can u post on any update on the Stay injucted by Hon.Bombay High Court on payment of Bonus @ 8.33% from retrospective date of 1.4.2016.
Is the stay is vacated or ruling is passed.

As per the template, it is only asking for the suggestion and not for any stay on the former rule passed. Please clarify.

The above notification is something different.
What I wanted to know is whether the Hon. High Court had given any ruling on the WPL-1548 putting Stay on the Govt. Gazette notification dt. 1.1.2016, which said bonus at 8.33% is applicable wef 1.4.2014. The stay was also granted by different High Courts.
Kindly update on this.

In my opinion stay is granted only to those employers, who have/has filed the petition on some bases and not to all employers of the state or whole state.

Dear all,
My comments please:
1) Above posted notification dated 6.12.2016 is final notification after getting comments from public.
2) Various High Courts, including Bombay High Court, have granted stay to retrospective amendment of the Act.
3) Being Central Act, stay is applicable throughout India.
4) Writ Petition filed by Tech Mahindra in Bombay High Court is fixed for hearing on 12.1.2017. Till then stay will continue. Copy of stay order dated 13.6.2016 is attached for reference.

Dear |C Agrawal Sir,
There is some confusion. For the purpose of Calculation of Bonus payment, what is the definition of Minimum Wages - Is it Basic OR Basic + Special Allowance, notified from time to time.
Some members are suggesting that Basic is the minimum wages for Bonus calculation.
Kindly clarify me.
