Hi, One employee has used bad words to a other Sr.employee not face to face it is sharing his feelings with his one of colleague in a company communicator and the same manager came to know about it and taken discussion and employee had accepted that am not suppos to but i have been mentally tortured so that leads to use those words.

But company said u have miss used the company IT so u have to give resignation and employee agreed to resing and serve notice period but Hr said u can not serve notice period as per the company policy and said i will settle all the FNF till date and employee asked will my paid leave pay also given in FNF, yes they said wil give pay for that and they did not mention ur notice period recovery will deduct, but they asked me to mention for personal reason u are resigning job and could not serve notice period employye agreed and given resignation as per their guidence.

So my query is will they deduct my notice period recovery in FNF because they did not mention that and he did not enquired about that but as per the company policy if they dont serve notice period they recover one month salary. Later if they deduct the recovery of notice period how he can leagally question them for this.

Please help on this

If you resign with immediate effect (even if such resignation is at the instance of the management, which unfortunately you are unable to prove) without serving the notice period ( assuming that you are unable to prove that you were asked by the management to resign immediately) then you become liable to pay the equivalent amount of the notice period to the management for not serving the notice period.
Management is simply 'tricking' you in obtaining the resignation from your side with reasons of resignation being 'personal'. Otherwise, for terminating an employee, the management has to follow certain procedures which they generally want to avoid.

Dear Anonymous ftiend,
You are raising a query hiding the facts creating utter confusion. In the starting, you mentioned about an employee and later you came to gender of 'I' and 'me'. When you are raising the query as anonymous person, you shouldn't afraid or fear, rather should come out with clear inputs, which helps us to give a legal backed solution.
Now coming to your query, since you have mentioned that the management has asked you to give resignation stating that you resigned due to personal reasons and couldn't serve the notice period, to which you have agreed.
In my opinion, since you are resigning on their insistence, they shouldn't deduct the salary for notice period. However, before putting your papers, it will be better if you can discuss with them to avoid complications at later stage.

Sorry for that Mr.kalsi sir. Actually am the employee. And for using the bad word they can not terminate as per my knowledge rather they could have placed me in other branch but their intention is to send me out. I have used company messenger to share my feeling with my close colleauge and expressed in bad words. Bad word means THESE FUCKERS which i used and i use to argue with them when they intention want to hurt.
Because they intetionally did this and they use to track what am doing in system.
In performance wise i am good am not giving chance to find mistake.
What ever they ask i use to give them real time data.
If they deduct my notice period recovey how i can fight leagally to get it.

One thing i am unable to understand in this case, is why are you giving notice period even when company want to sack you. as per my knowledge if an employee want to leave the company with immediate then employee have to pay notice period or have to serve the same and if any employer want to sack employee for any reason whatever employer have to pay notice period or give time for serving notice period. then why company is asking to deduct the notice period amount from your F & F payment ?
