Please help me to understand working hours in case of security and housekeeping people employed through vendor.
1. As per law maximum 8 hours in a day and 48 hours in a week - is it includes meal break time also ?
2. If a person works more than 8 hours, OT is to be paid per hour @ twice of his gross salary.
3. If a person works on 07th day(week off) also, amount is to be paid twice of his per day salary.
4. What is reliever charges @ 16.67% means? is this also weekly off payment or is this means charges for actual replacement of guard by other guard for that (week off) day .

Yours is a general querry, there may be no. of assumptions on basis of querry raised by you. However, pls note my reply of the same:-

1 Generally the security contract is awarded on basis of round the clock services. The security personnel perform 08 hrs duty and reliever each other as per rotation. In such case the duty time is inclusive of meal break. However, it the security is deployed/required only for general shift (as per office timing) ie-9:00 hrs – 18:00 or so, in such cases the meal break can be excluded from duty hrs. (The security agency manages those things).

2 If any person works more than 8 hours, OT is need be paid per hour @ twice of his gross salary.

= LEGALLY IT IS CORRECT

3 If a person works on 07th day(week off) also, amount is to be paid twice of his per day salary.

= ABSOLUTELY CORRECT (Though there are ways for cost optimization).

4 What is reliever charges @ 16.67% means? is this also weekly off payment or is this means charges for actual replacement of guard by other guard for that (week off) day.

As I already mentioned “security contract is awarded on basis of basis of round the clock services”. After 6 days duty the SG is being allowed one Weekly Off (Rest), that day the security agency will provide you alternative SG (to relive the SG). So it is called “reliever charges”. The 16.67% is arrived by total cost divided by six. Let the SG monthly cost is 10000/pm excluding the w/off. so Rs. 1667/- will be separately added for the W/off SG duty.
