Dear All,
Based on the reviews you have shared on contract labour i have few queries. Please clarify.
I require 10 employees to do a carpentry work at my client place and we have an agreement with the client and i am not sending the labours who are working in our Factory under our contractor.
Any employee who is not working in our factory cant be considered as an employee as there is no employer and employee relationship.
Meanwhile i need to send the Carpenters to my client place and they need to cover under Statutory requirements. Please suggest me how to cover them under ESI and EPF and i cant include them under contractor as the work duration is not permanent.
Can we take them as Temporary or Badli workers and can we pay EPF and ESI from our code.
Looking for the expert responses on the same as we are not getting any clarity on the above queries.

Hope you will agree with me that employer-employee relationship is not always confined to the place of work only. If you apply this principle to the situation you've described, you will straight away come to the conclusion that the ten people directly recruited adhoc and deputed by you to the client's site to do the carpentry work undertaken by you would be your own employees not withstanding the duration of the work or their employment. So, they have to be treated as your temporary employees and extended all the benefits of the applicable laws.
