Dear Shankara, Form 5 under CLR Act is being issued by Principal Employer to Contractor Or Agency which have to work through their manpower and for a particular period.

For obtaining the Labour Licence under CL Act, the Principal Employer has to issue the Form 5 (Certificate from PE) and Copy of Form II (Certificate of Registration of Establishment) to the Contractors whom the PE wants to engage in their Establishment to do Contract work.
In addition to LOI / WO, Form V & Form II, the Contractor should prepare form IV and submit the same to Licensing authority alongwith the Challans for Security Deposit and License Fee for obtaining the License under Contract Labour (Regulation & Abolition) Act, 1970.

The undertaking in form V is given by the Prinicipal Employer Stating that "I/We undertake to be bound by all the provision of the Contract Labour (Regulation & Abolition) Act, 1970,in case of failure by the Contractor"
But in case of Principal Employers like Nirav Modi and Choksi who ran away after taking the services from the Contractors, what should the hapless contractors do for payment of Salaries and other statutory payments to the Workers ?????
