I worked for 4.8 Years for a company and today i received a mail from my senior mentioning your employment is terminated with immediate effect. Reason given was Performance issue. I am from HR field but not able to find any law in books which can prove this decision wrong. As per my understanding , you can not terminate a person on performance ground after so long. As per my lawyer this can be proven in court as wrongful doing by the company. I do not want to pursue that route unless deem necessary as i can not carry a blot on my career. Pls suggest.

Under Bombay Shops and Estab Act, employee cannot be removed without reasonable cause. Also under section section 9 of Indian Contract Act, after this long there is a deemed understanding between employer and employee that can be treated as a contract. So you can move for breach of a oral or tacit contract. So visit your local labour inspector for help. See the website below for process.
