Hi,

I was working as Deputy Manager in a company in Kolkata for their Retail & Restaurant division. From last Dec'15, the company suffered some losses in other branch of business, as was communicated to the employees. This resulted in our salaries being paid late with gap of more than a month, also we were being informed that our bonus, being part of our CTC and which was deducted every month from our salary only to be paid as single amount. Also, we were not provided with the leave en-cash amount in Jan'16. Still most of us stayed back due to our allegiance towards the company, but on Mar'16, I got a better opportunity and planned to shift, which I had mistakenly shared with my boss. This resulted in my salary being held for Mar'16 and finally frustrated I resigned on 01/Apr/2016 and asked for release on 07/Apr/2016. As we have agreed notice period of 1 month, I agreed to adjust my leave and amount with remaining notice period days. Though I feel that nothing should be deducted as I was not provided Salary for 2 months at that point of time. They have accepted and released me on closing hours of 07/Apr/2016 after completing all handing over formalities with all the departments. On that day, the HR department said that I will be issued the Release/Experience Letter and I can come & collect any time after a week. Regarding F&F settlement, they said by May'16/Jun'16, I will be informed about my cheque. Till date I have received non, in spite of several follow-ups every month. Since last month I have been following up for my Form-16, so that at least I can submit my ITR, there is no response till now.

Kindly suggest a way out from this trouble faced by me financially as well as mentally.

Please consult a lawyer and send them a notice. Try and get other people along with you who are facing this the same issue from the organisation.
Also please check your appointment letter for any clause related to delayed salaries.
Put up a strong case and you can always approach Labour court for resolution of this issue.
