Pf transfer from epfo to trust
Hi my previous company maintained its pf with epfo mumbai but new company its a foreign bank has its own trust. i applied for transfer of pf from epfo to my new firm s trust by filling up the relevant form and submitted to hr of my new firm who in turn submitted to but epfo rejected the request saying: as epf act is not to the bank is to form 10c for of pf & fpf . my firm s hr explained that above comment is slightly confusing and actually epfo means to say : i can transfer the pf from epfo to trust. but since my firm s trust only takes care of epf and not eps for pension therefore epfo wants me to withdraw the eps amount by filling up form 10c and then they ll allow transfer of epf to my firm s trust. now i wish to know: 1 in such case pf transfer from epfo to trust is it really mandatory to withdraw the eps amount? if not mandatory should i again contact 2 i am in no need of surplus funds at the moment so what is beneficial in long run and how withdraw eps or let it remain with them? kindly advise. regards vaibhav

Can we transfer pf from epfo (govt.) to pf trust (private)?
Hello can we transfer pf from govt. epfo to any private pf trust? brief background on this question is i worked for a company a in bangalore and that company had my pf accumulated in pf office karnataka. i quit company a and joined company b where company b is in maharashtra. company b doesn t have pf with govt. but have a pf trust maintained by some private company. now i filled form for pf transfer and sent it to company a for transfering that pf amount to current company s pf trust. after 9 months i see the status of my application to be "denied/ rejected" stating the letter has been sent with details for rejection. of course i didn t receive any letter from them yet though. i again applied pf transfer it was rejected again. with all this wait time of over 1 year i now have applied for pf withdrawal forcibly which is not recommended though for any employee working for private companies. and hope it will be processed with no issues this time. my question is can we transfer pf from epfo govt. to pf trust private? please clarify me on this. i m assuming an answer to this question to be a 'no' because my application has been rejected twice. please share your thoughts on this and correct me if i m wrong. thanks & best regards bk. thitherwards
Legal heir eligibilty during epf withdrawal claim
Hello respected members i am going through a lot of confusion in trying to get the epf withdrwal claim of my father settled. let me state our case in detail. my father untimely and suddenly expired in april 2009. at that time he was employed with a company which he had joined about 8 months prior to his demise. before that he was working with a company at hyderabad and he had submitted pf transfer papers from hyderabad epfo to the present gurgaon epfo pf account. but even before the pf got transferred he passed away. we waited for the pf transfer from hyderabad epfo to gurgaon to get completed before we withdrwaing his total epf from gurgaon the transfer process took around 3 years after repeated followup and the transfer happened around may2012. following this we submitted pf withdrawal papers to gurgaon epfo in the name of my mother who was the nominated by my father as the nominee through form2 declaration. wes submitted an employer attested copy of form2 as well along with the withdrawal papers. however now gurgaon pf office came back saying that as per them the form2 was never received by gurgaon epfo from the employer until the same was received along with withdrawal papers. so they cannot treat this nomination form as valid and will ignore this nomination and will equally distribute the pf amount between the legal heirs. my question is who are the lagal heirs in our case? our survivor family consists of my mother and her two daughters including myself. family details as on april 2009 at the time of my father s death: wife: 50yrs first daughter: >25yrs unmarried second daughter: >25yrs unmarried family details as on may 2012 when submitting the pf withdrawal claim: wife: 53yrs first daughter: >25yrs married second daughter: >25yrs unmarried the pf department is now saying that the pf withdrawal amount will get divided equally between mother daughter1 and daughter2 as both daughters even though were greater than 25years of age but being unmarried at the time of will be eligible for the pf amount including edli claim. however another department in the pf office is contesting this. as per the other department the definition of legal heir is considered per the family status as on date of the and not as on the date on death. so as per today s family status only mother and one daughter are are valid claimants. can experts please guide on what is correct? they have complicated our pf claim amidst all this confusion one department saying something and the other within the same pf office saying some thing else. everytime they call us up requiring a new pf withdrawal form with a new name. initially we had submitted the forms with only my mother as claimant. then they asked my sister s form and now they are asking my form as well. we just want this to get settled and have really no problem wether the whole money comes to our mother or gets divided between the three of us as internally we intend to anyway transfer everything to our mother. please advise how should i tackle this? is there any document which states if legal heirs are identified based on the current date fmaily status or family status on the day of death please please someone help us. thanks ritu
Transfer pf from previous employer to current employer
Hi all i was working with a company from may 2013 to july 2015 then joined b company on the same month and working there presently. now i would like to transfer my pf from a company to b company provided both the companies have proper digital signatures in epfo website. but the issue is my previous company has been closed 6 months back. since both the employers having proper digital signatures there is no issue in submitting online transfer through epfo portal but though if i choose the attestation through my present employer it seems like epfo will contact previous employer for some verifications. i m not sure what to do on this issue now it would be great if anyone could guide me on this.
