I have joined as Advisor but my immediate boss asked me to do other than Advisory work. I am in central Govt Job. Please suggest.. Thanks

Dear Shailesh,

Whether you are in Govt.service or in Private sector employment, you should constantly remember the inevitable fact that it is your immediate boss who is capable of making or marring your career. In day today administration, some times it so happens out of necessity that subordinates are asked to do certain things totally unrelated to their job-profiles. It should not be construed simply as cynical manipulation of authority by the superiors. Your boss might be of the opinion that you can handle such unrelated job or typical situation more effectively than others or even better than himself. But, if it becomes usual thereby preventing you from discharging the actual responsibilities assigned to your post or the very nature of the thing you are asked to do is not befitting your official status, really it is a matter of concern to be dealt with deftly. In such a situation you can convey to him politely that you are not there for doing such a thing whether it be an order or request. Let the refusal be tactful and its expression be polite and convincing without questioning his authority.

If some thing goes wrong than I can challenge in the court of law. If any such citation of Supreme Court Of India on the judgement that immediate boss can not ask you to do other than assigned task. Please be provided.

The above recipe as an advice of Mr. Umakanthan is like one way traffic for persons retired and retained by employers like you, is the best recourse ,may please be noted. Your reporting authority is de-facto chief who can or may not allow extension or termination of your engagement, be sure. It may happen , mostly in PSU/ Govt. organizations, the assignments given by immediate boss to you is purposely decided while he sees you apt and more fit than all those things are running in your mind. There must be one specifically announced clause in your engagement letter that your superiors will assign the jobs from time to time basis any other requirement than written and you are under obligation for those activities also.

Suggestions to you is -Never engage yourself after retirement into any legal battle. Its not at all advisable.Be happy, active, lead tension free , trouble free and healthy life!!!

There is no indication in the post that the questioner's appointment is that of a post-retiral engagement or extension of services. Whatever it be, one can not expect judicial precedents in respect of all the day to day incidental matters of employment. When an employee is asked to do certain additional works, every boss knows that it is only a stop-gap arrangement without detrimental to his/her normal works. However, it does not mean that it is only such a formal arrangement so as to defeat its very purpose by the improper handling of both the jobs by the employee concerned.In such a situation the employee has to be doubly cautious in respect of his original and additional responsibilities. After all, effective execution of one's official works, in essence,is just a matter of prioritisation.

Shri Umakantahan SIR / Shri RDS Yadav SIR,
With due regards, I may add that, I have not joined after retirement but joined on deputation through UPSC and I want to stop such practice as I am least bothered about my promotion and transfer etc.
Therefore, I am seeking a citation of Supreme Court of India Judgement that employer or immediate boss can not ask to do so other than assigned task.
Please extend all your co-operation fight for right in the interest of all concerned by providing SCI citation and or pursue the matter at the appropriate forum.

Dear sir,
There are various judgments in favour and against employee,SCI has been doing this daily.The nature of your jobs assignment which you are supposed to do and other jobs you are not supposed to do but assigned to you needs to assorted , categorized , weighed in details before any guess. Each case depends basically on merits ,how it has been presented in plaint and argued. I wish to advise you to contact a senior counsel dealing in such matters for right advise and develop a comfort and condidence .
