Dear Seniors
Assume on 24/10/2016 there was sunday (weekly off) as per our factory leave policy, however one of the employee has worked till 23/10/2016 (saturday) after that he was absent from 24/10/2016 till 27/10/2016. Pls clarify in this scenario weather sunday (weekly off) will also be marked as absent or not as per factory act.

See there are two laws in action here :-
1) Under Factory Act you cannot deduct the wages. As it is mandatory 1 day paid Holiday in a week.
2) Under Shops and Establishment Act also there is 1 day paid holiday in a week. see https://shopsandestablishmentactsindia.quora.com/
So you cannot deduct what he is legally entitled to.

Dear Sir,
In this case,ie 24 th to 27th absenteesim, usually many companies have policies which determines that Sunday(24th) is considered as weekly off as the person has attended his duties the earlier day and 25th, 26th,27th will be considered as absent.. If he is absent from saturday (23-27th). then the sunday will be counted as absent. so 23,24,25,26,27 total 5 days will be considered as absent.

Under the factory act, anyone who has worked for 6 days is entitled to a paid holiday on the 7th day (Weekly off). So if he takes leave from Monday, his Sunday can not be considered as leave or absent. He is entitled to payment for it.
If however, he is in leave both Saturday and Monday, he is not eligible for payment for the Sunday that comes in the middle.

As per sunday weekly off policy 50% present in weekly manadory present on saturday / Monday then you entitle benefinary for sunday.
