An contract employee transfered from one organisation to another organisation during maternity leave. The employee is covered under ESI. When the employee delivered a child she was in new employer. Both organisation were under same principal employer.
Technically whether she is eligible for ESI benefits under new employer.

Yes CL is Eligible for ESI Benefit from the current employer. But also transfer the Old ESI Contribution to current employer
As per the rules any woman shall not be allowed into the factory while she is conceived. However if allowed its a sensitive issue to handled according to the situation.

yes she can avail M benefit under ESIC , but only if she continued with the previous IP no i mean previous esic No , she can transfer her previous contribution to avail full benefit .

Yes she will have to be covered ,if not the Principal Employer will become liable.From the Employees point of view she needs one coverage on all Statutes i.e Law from whom is not her problem.

HI She is eligible to get the M.B. under ESI Act, only thing she has to convince the ESI Authorities about her past contributory service with other employer, regards Hiren Chheda Mumbai
