my worker met with an accident some 2 yrs back when he went out on duty for factory work.he fell down from the bus and had an internal injury in his head ,nw he complains of head ache and develops fits due to the same. he wants the medical treatment expenses to be borne by the company. But he has esi facility .
can we refer to some Dr. in private hospital and claim the bills from esi . is it possible ? . Are expenses incurred in private hospital for a esi covered employee is reimbursed ?
pl let me know.

ESIC TREATMENT IS MATTER OF CHOICE AND NEVER A MATTER OF COMPULSION
ESIC WONT COVER THE EXPENSE, IF TREATED IN PRIVATE HOSPITAL, BUT THE COMPANY WILL HAVE TO BORNE THE EXPENSES, AS THE INJURY CAUSED TO THE EMPLOYEE IS WHILE HE WAS ON DUTY,
THE ESIC WILL PAY HIM FOR THE DAYS HE WAS NOT ABLE TO PERFORM HIS WORK

Hi ! Its is not an issue ESI has their own medical facility u can send him to esi hospital to have treated by their doctoras they will look into the matter if he cannot be treated in an Esi hospital then they will refer the case to some other better hospital, Other wise their is no liability of employer if it's covered under ESI he can get paid from esi for number days on rest as adviced by doctor and can avail medicien and treatment from esi itself u just have fullfill the formalities required by esic to prove that he's on rest or esi leave mark him on esi leave on payroll records not as absent and dont pay any thng on records so that it is proved that the person is on esi leave.

If the disability complained of is the proximate cause of the accident while he was in the course of Employment he can avail Workmen Compensation,if not he should be satisfied with ESI coverage and take treatment.If the disability is such that he cannot continue his work and needs to be discharged then he can avail the route of Work mens Compensation The Employers need not fret as they would have taken a Accident coverage.Pls check out that angle.
