Dear Concern,
If any employee leaving company without giving resignation and without servicing the notice period after that he is asking for the F&F. after1 months. Already the employee was voluntary discontinued by the employer.
So what will be the next step? He is continuously demanding for the F&F.

Dear Sarbanti,
When employee leaves the employment without giving proper resignation or completion of notice period, it is called as "abandonment of employment". When employee abandons employment, before striking off his name from the rolls of the company, you need to conduct the domestic enquiry. A suitable punishment may be given depending on the number of days of absence.
In your case we need little more information. Please confirm when the employee joined your company, when did he leave, what were the terms and conditions of the notice period, do you have standing orders approved by the labour department, did you send any notice to him for his absence, etc. There are so many questions associated with your post. Please given further information to get the right suggestions.

Hi Sarbanti,
Adding to what Dinesh has said, did you send in a showcase notice to the employee's home address? What action did you take when this employee absconded? Also he cannot take any action against you as he had absconded and his plead will not be void under the court of law. First inform him that according to the company policy if any employee goes on an uninformed leave for more than 3 business days then he/she would be considered as not interested to continue their employment with your company, and they shall be removed from the payroll/employee list. Make these changes in your Hand Book with immediate effect.
