Greetings everyone,

I was working with a partnership firm registered from Mumbai on the post of Marketing Manager. I was associated with this firm for past 16 months and I was doing very good at my performance. During this period, I was also given an appraisal at the starting this FY of 8% for good performance.

However, I was recently terminated with immediate effect by management. The thing is, I was not well since Sunday which I informed to HR via my wife on Monday as I was having weakness. Fortunately, that call was redirected to one of the Director who also happens to my immediate and only reporting authority. When she mentioned about me being ill (she thought she was speaking with HR) and not in a position to come today, he replied to her saying I'm no one's servant and just hung up on her. After an hour or so, I got a memo from my office asking for justifications on stupidest things and one of them was taking leaves only on Saturdays. (I had taken a leave on previous Saturday as well). I was asked to reply by next working day, as very next day was a public holiday.

But even on next working day, I wasn't fully recovered and had to again go and visit doctor as my symptoms were of that of Malaria or Dengue. But I replied to mail stating I'm still unwell and will reply once I am fully recovered and rejoin the work.

On the very next day, early morning I got a call from same director asking if at all I'm coming on that particular day. Me being still weaker, my voice was mellowed and replied I may not be able to come. Then he just got pissed and said to me that not to act and speak properly and he again hung up. I tried calling him again 4 times, calls went unanswered. Then after some time, he calls back again. That time I asked him, sir what do you mean by not to act while talking. I was unwell so that is how I will sound. He then said i should have informed him and not HR about my absentism as he is the one who pays me and not HR. He then started verbal abuse and used unspeakable words. I even put that call on speaker for my wife to hear, even she was shocked to hear his tone and things he said. He hung up on me saying you are fired. I was speechless.

I knew he had temperament and last person before me working here had a regular fights with him before leaving the job permanently within 6 months or may be less.

But then, after noon, I got a mail from HR of immediate termination and asking for handover by next day. Mind you, I was still not recovered and was about to change doctor as there was no big change in my health.

Talking about leave policy of our company, we get 22 leaves in a FY which can be enchashed for basic pay of those days. Plus, public holidays are not declared well in advance for us. We come to know if next day if a holiday or not only after 6pm. That too leaves are at sole discretion of the management.

The leaves which he accused me taking on Saturdays were mere 4 since April till October out of which 2 were already informed to the management (1 i took for shifting my residence, as it is definitely not a one day job so combined Saturday with Sunday. And other i took on August 13, as it was the only long weekend which was there with us and we had a family outing planned. Again, both these leaves were informed well in advance to the Director and HR). The one which was taken recently, was for my wifes health reason (she is 3 months pregnant and is going through a lot of pain due to which she was already on a leave from her job a week prior), which was informed a day before to HR. Please also note that, I have not taken 2 consecutive leaves in my tenure with this firm,in case someone says my leaves are regular or equispaced.

When I received the letter in my mail, I immediately asked HR as a reply to that mail asking for the reason to be mentioned for termination in that letter. Also I asked to settle my pending two travelling bills (around 15-20k) along with payment for these 10 days and notice period. There has been no answers provided from the company.

I'm sure that our director has temperamental issues, he won't settle all my dues and will keep me for dry. This has affected me psychologically as well.

I seek right guidance and actions which I can take as I know I'm not sure fault and sure as hell won't let the company get away with what they did just to serve their ego.
