Dear Members, my friend who has put in 20 years to a reputed organization and is undergoing a difficult situation. The people joined with her then or after her are at the designation of Directors/ Sr VP today in the same organization, however she is in designation of Manager till now. During her tenure here she has served in three different departments with in organization/ group of companies and her promotion is stopped deliberately since 9 years which would have elevated her to at least three more levels by now that is at the level of VP. She was mentally harassed & tortured continuously by all the bosses she was reporting to since 9 years. This was reported and brought to the notice of company's ombudsman timely. The ombudsman has never shared the actions taken against her bosses, but they have changed the bosses whenever the incident was reported to them.
Despite of all these challenges till 2014-15 she was rated as a good performer in her assessment (not excellent or outstanding which is above the ratings received) by the management but was not promoted or role enhancement was given, but last year 2015-16 she was rated as an average performer only (which is a level below the Good Performer) and is been asked to leave the organization by her reporting boss indirectly. She is under pressure and mental agony. Now she is giving a thought to file a case against the management.
The organization to which she has devoted her 20 years of life is giving the returns in this unpleasant way. Please suggest, guide and also let us know what are her rights and under which law/ clause she can file the case against the management and what compensation she can claim from the company genuinely if permitted by the law of land.

GETTING PROMOTION CHALLENGING IS OF NO USE.. U DIDN"T TELL IS THAT A PUBLIC ESTABLISHMENT...
IF IT IS A PUBLIC LIMITED COMPANY GO AHEAD... IF NOT NO USE...
SEVERAL PARAMETERS TIME TO TIME ORALLY OR IN WRITTEN FIXED BY PRIVATE COMPANIES WITH ITS WHIMS AND FANCIES..THAT IS NOT WRONG.. THEY SHOULD HAVE THAT POWER.... UNLESS Y FOR A PRIVATE COMPANY....
NONE CAN CHALLENGE THEIR RIGHT TO TRANSFER PROMOTION INCENTIVES....ETC....WHAT EVER THEY WANT THEY WILL GIVE ANY ONE THEY LIKE... A ROOM BOY MAY BECOME REVEPTIONIST OR MANAGER BY A NIGHT....
SO NO ISSUE...
IF THEY DIDN'T PAY SALARY....
NO INCREMENT...
DELAYED PAYMENT
OVERTIME....
PHYSICAL OR MENTAL HARRASSMENT (EXCEPT PROMOTION)...THEN IT IS AN ISSUE..
HOWEVER IN UR CASE SOME ACTIVITY DONE...CHANGING BOSSES AT UR COMPLAINT..
SO TRY...
BUT DONT HAVE SO MUCH EXPECTATIONS..
SOME BETTEREMENT MAY BE ....

i see you are loyal to your friend and therefore unable to see the writing on the wall.
Your friend has not been promoted for the last 9 years (out of 20 years she has worked for the same organisation). She has a problem with each of her bosses.
If someone has a problem with everyone, its more likely she is the problem. So i think her performance is below what the company is expecting (note she was "good", not excellent, and therefore not the Managerial material. Her confrontanist attitude is also a factor for not being promoted. No company wants such a person in the top levels.
Taking legal action for not getting promotion is meaningless. Further, the concept of being constantly mentally harassed is also probably in her mind. Probably for her, being asked to work and deliver on time is harassment. You need to ascertain the facts, then speak to a lawyer specialising in this field and then work out what your action should be.
