I am currently working with one of the Pvt Ltd consulting firm. I have resigned on 1st august and serving notice period. however since the time i have resigned my boss is sending me insulting emails etc. I already have an offer with me and would want to join them ASAP.
My boss during my 1st conversation got angry and told me verbally that we will relieve you in the 2nd week of August. In the 2nd week when I asked him about my relieving he told me that I have not thought about it and will think about it and let you know in the next week. I waited for his reply in the 3rd week but no reply from him.
Later I went again and asked for discussion on my relieving date. he told me that he has got 90 days to respond to resignation (as being a confirmed employee of the company i have to serve 90 days notice as per appointment letter). further he also added that whatever you want to do you may do it and whatever I want to do I will do it. if you dont want to wait for my reply then pay the money in lieu of notice period and you may go. Post our conversation he replied to my resignation email saying that I will come back to you on your resignation request at the end of September. later again I has several verbal conversation to waive off my notice period and relieve me by Sept 15th as I dont have any important work.
However my boss had gone on vocation from 1st sept to 22nd sept and while leaving for vocation he sent me an email saying that we will discuss about you on 23rd.
During this period he has changed company policy twice as also incentive scheme etc. and every now and then sending me insulting emails etc.
Now if i leave the company with serving 2 months notice and If I dont pay any money in lieu of notice then what legal actions will he take?
Kindly help. I have worked for this company for 5 years and boss is behaving weirdly / immaturely.
