Should we hold salary of employees who have resigned & are serving notice period?
In a typical case with an mnc they have a clause written in their appointment letter with respect to notice period in case of resignation. during training or probation the notice period is 15 days & post confirmation the notice period is 90 days. my question is that in case if a confirmed employee having notice period of 90 days resigns then is it necessary to hold his salary fully / partial until he completes his notice period? in case if we do not hold salary & the employee leaves without notice & without completing the notice period then what can be done in such case?

Hi all i have one question regarding resignation under probation period in offer letter we have mention that you have to serve notice period for 1 month in probations period one of our employee is arguing that ' there is no any rule for resignation in probation period for one month as per law i am giving spot resignation and company has no rights for hold my salary " is it true? or not now a days company hold his salary and he is going to labour office for legal action kindly give me a suggestion what should i have to do ?

Regarding notice period details
Hi friends recently i have resigned in current company during probation period. as per my offer letter i need to serve one month notice period during probation or in lieu of notice need to pay basic salary amount of notice time. after probation period we need to serve 2 months notice period. as explained before i have resigned in during probation period so i am ready to serve one month notice period. but employer is asking me to serve 2 months notice period without any proper proof. i am not agreed for this because i don t want loose my new offer. but employer forcing me to serve notice of 2 month. but there is no proof of changing of notice from employer. even mail proof also. can you explain how i can proceed legally to get out from current company with revealing/exp letter with one month notice period.
