Dear All, Greetings of the day !!
We Got 800+ Employees In Different States of India (Mostly in all of them). We are a third party contractor kind of Firm. Our head Office is in Delhi, so I just want to know if we can submit LWF deduction of our employees in in Delhi, & according to the applicability of Delhi Labour department or we have to submit it to the different states where our employee is working .

It is surprising that the company with 800+ employees does not know the Law.
Labour Welfare Act is an enacted by State Governments / UTs. About 14 / 15 State Governments /UTs have enacted this Law. Applicability, contribution, frequency of contribution, benefits or welfare schemes etc. are varies every State / UT as per the provisions of respective Law.
Employees working in different States / UTs are subjected to the Law as applicable in the State / UT wherein they are working. It is a common Law.
Accordingly, you need to comply LWF in respect of employees working in different States / UTs as per the Law by respective State / UT wherein they are deployed or working.
Compliance of Professional Tax is also like LWF.
You need to follow Minimum Wage Rate as per the State Law, unless you are not governed by Central Law.
The Labor Welfare Fund is a State Govt. affairs and has to be deposited to their respective states, employee wise as like Professional Tax.

and the fact is that i just joined this company, and i'm the one who told them about the LWF law after checking their previous records, i came to realise that they are not deducting any LWF of any employee & doesn"t even know about this...and i was just not sure about the deposition of state wise, so just wanted to take some expert advice from all of you seniors.

Presently Labour Welfare Fund is not applicable in the States of Orissa, Himachal Pradesh, Rajasthan, UP, Bihar, Jharkhand, Uttaranchal and Jammu & Kashmir. In other states it is payable.

I just wanted to confirm that LWF act is applicable for contractor workers which are used in my establishment for the purpose of Civil construction?
Dear Friend,
LWF applicable for contractors even they are working in your premises, if they fail to pay the dues then liability comes to principle employer.
