Regarding the appoinement letter
Hello i had accepted a job offer by signing the appointment letter and my joining date was after a weeks time. the letter mentioned that "the appointment is in effect from the date of joining duty latest by ". a day before my joining i informed the consultant who was i touch with the hr verbally about my decision of not joining specifying the reasons. after this i did not receive any call from the hr/ consultant. 2 days after the joining date i did not join the organization i am asked by the consultant that i will have to return back the copy of the appointment letter to the hr. i would like to understand that is it a industry practice to take the appointment letter back in such case and what would be the probable reason behind it. i am informed by my consultant that they want the letter back in order to prevent any misuse of it. any information on this would be helpful.

Can i change my last working day - buy out was refused and then agreed to
Hi my name is anupam an exemployee of cognizant i had a discussion with the management on the 25th of may that i can no longer proceed with my duties for cognizant after 30th as i will be joining another organization on the 31st of may. on the 30th i rolled out the resignation with the same information. i received an instant reply from hr that bu is not considering the buy out. suddenly on the 1st they were ready to consider the buy out and gave me the last working day on the 3rd of june thought i was not working for them at that time they still considered it as my last working day as per the hr the last working day cannot be changed as i never had the discussion with management. however in the emails as well as the discussion i have with the management i specifically mentioned that i will no longer work post 30th. what should i do in order to seek help?

Hi i am working in a reputed software mnc and i have resigned from my job last month due to personal reasons. no one in my company gave a notice period of 3 months and now my company is stuck on 3 months notice. i have even offered to buy back the notice period but hr said it is at the discretion of a company and company is not willing to offer buy back option. regarding handover formalities everyone knows that it is just 2 weeks required to complete that even then they are forcing to stay for 3 months. since they know that i can t stay long they are not giving me any option. my question is if i am willing to buy back the notice period and company is not willing to do and if i stop going to office can the company say not to give me a releiving letter ? how one can sit on desk for 3 months just for the company as it wanted to discourage other employees to leave many thanks cr

Dear sir just wanted to confirm some issues for maternity leave for one of my friend. she is working in a company from past 1 and half year. now she is expecting a kid. now she has written an application to the firm stating that she would not be able to come for next three months. since the firm is a very small of not more than 9 employees and do not follow any compliance they are denying to pay any payment for gratuity leave. although my friend is also not asking to pay her for 3 months but she wants that company should keep her back on work when she will get back from recovery. but the company is telling they cannot keep the post vacant for three months and that would be difficult for her to join back in the organization. is there anything she can do so that company cannot terminate her. note: she don t have any joining letter of that organization and no salary slip or formal communication from office.
When does the employer - employee relationship actually end - legally
Hi respected seniors of this community i have seen many contradictory statements in different forums regarding the way and process of ending employer employee relationship. so i m putting forward a very basic question due to my unawareness of law. if an employee suppose working for a month or two during probation wants to end the relationship with his employer when does it actually end? 1. if he resigns and serves the notice period mentioned if any then on his last working day. 2. if he resigns with immediate effect and doesn t serve the notice period but willing to buy back the notice period then once he pays the full amount then only the relationship stands cancel. 3. if he resigns with immediate effect and is willing to buy back the notice period even if his company doesn t accept the resignation on the day of resignation the agreement stands cancel. in first two options an employee can be properly relieved i guess. but if somebody resigns with immediate effect and mentions in his resignation letter that he is ready to buy back notice period as per employment agreement and the employer doesn t accept it for may be say 1015 days or may be more than that then can the employee say that his relationship ended the day he put down his papers? because theoretically he intended to buy his full notice period so does he need an acceptance on resignation in this case? or without that he can claim the agreement is over. if he needs an acceptance then also why? awaiting some views on it.
