Compensation where employer asked the employee to resign - employee is asking the company for 2 months' salary
The employer asked the employee to resign. the grounds were employee didnt perform well. the employer did not want to terminate as the company s face value will hamper. so the company asked the employee you resign. the employee resigned and within 1 week the company said it s your last day. now the employee is asking the company for 2 months' salary. if the company does not pay then it will be forced resignation the employee says. can you advise me from the companies point of view here i want to save the company.

Notice compensation with no mention of it in offer letter?
Hi please go through the below mention circumstances and reply me with ur suggestions: recently i have resigned from a company recruitment firm without providing notice period to them and i have written in the resignation too the same thing but they did not accept my resignation. as in the offer letter which i got there was only mention that if i want to leave from their employment i have to give 60 days notice during probation. i was in probation but i resigned without giving notice. they did not mention anywhere in offer letter that if i wont serve notice period then i have to pay compensation against it. now they are asking for compensation of notice period but they have not written any where in offer letter nor it is there in their policy. the day when i left i told them clearly that i wont come from the next day and they said ok.. on my last day also they did not say anything for notice and compensation. i have already given them a replacement for my position and they have hired another employee as well. now plz suggest when an employer has not written anything in offer letter is it a valid thing for which they are asking compensation. regards chandni
Bonus payout is not clearly mentioned for resigned employees
Hi i have a variable component of 10 percent mentioned in the ctc. in the employee agreement it says bonus will be paid annually. thats it in entire document thats the only about the bonus. it doesnt say anything for resigned employees. usually bonus is paid in march payroll. my last day is on 8th of march. when i asked about my variable compensation they said i will not receive as im not employed until 31st march. i argued where it is mentioned. they told that bonus will be paid annually itself says everything. i further argued that im present for march payroll wouldnt be that enough. is my argument valid? can i do anything about this?

Hello guys i m going through a strange case i m working in a pharma company and recently one of my employee resigned from the job now he would like to go on leave whereas we do not allow the leaves for an employee who has resigned the job. is it a mandatory for not allowing him the leaves or it s a company policy. when i asked him he cannot avail the leaves he said that leaves are availing from his balance leaves. could anyone please pass the information of it. thank you. with warm regards. anand.
